OEM Toy Factories in China: How to Manufacture Your Own Toy From Scratch

In the toy trade, OEM means a Chinese factory manufactures a product you designed, to your specification, on tooling built for your product, and the finished item leaves the line carrying only your brand. The factory is selling manufacturing capacity, not an idea. That single distinction determines everything that follows: who owns the mould, who pays for development, whose name is on the test report, and who is legally answerable if something goes wrong in the market.

When is OEM the right choice?

OEM is not automatically the smarter route. Choose it when at least one of these is true:

  • You have a genuinely distinctive product that does not exist in factory catalogues, and that distinctiveness is the reason customers buy from you.
  • You are building a long-term brand and need a shape a competitor cannot simply buy a copy of three months later.
  • Your volumes justify tooling. Mould cost is amortised across units; very small runs make each piece more expensive than buying an existing design.
  • You hold a licence or content that must be expressed in the geometry of the product itself, not only on the packaging.

If your goal is simply to enter a market quickly with a price-competitive item, ODM — putting your brand on a design the factory already owns — usually serves you better. OEM buys differentiation in exchange for time and responsibility.

What is the development sequence from idea to production?

  1. A written specification. Function, target age grading, materials, dimensions, weight, sound and light features, battery type, packaging, and the destination markets — each market drags its own standard along with it.
  2. Industrial design and 3D data. Manufacturable CAD files, not marketing renders. The factory needs wall thicknesses, draft angles and boss positions.
  3. A hand prototype. 3D-printed or hand-worked, to test size, proportion and grip before a single yuan is spent on steel.
  4. Design for manufacture (DFM) review. The factory returns a report proposing changes. This stage saves more money than any other in the project.
  5. Tool cutting and the T1 sample. The first shot off the mould. Expect T1, T2 and sometimes T3 before approval; iteration is normal, not failure.
  6. Pre-production sample in final production materials and final retail packaging. This is the sample that gets signed, dated and kept by both sides as the reference.
  7. Third-party testing, then mass production with AQL inspection during the run and again before shipment.

Who owns the mould, and why is it the most important clause?

The tool is the real asset in an OEM project. If you paid for it, the contract must say in plain words that it is yours, that it will be released or transferred to another factory on your instruction, and that the factory may not run parts from it for any third party. Add clauses covering where it is stored, who maintains it, the expected shot life, and your right to inspect it.

In practice some factories share the tooling cost in return for a volume commitment. That is a reasonable trade, but write down who owns what and what happens if the volumes are not reached — otherwise the mould quietly becomes a commercial hostage.

How do you protect artwork and intellectual property?

  • Sign an NNN agreement — non-disclosure, non-use, non-circumvention — in Chinese and under Chinese law. It is far more enforceable in practice than a foreign NDA.
  • Register your trademark in China, not only at home. Chinese registration is what lets customs stop a counterfeit consignment before it leaves the port.
  • Consider a registered design if the external shape is your differentiator.
  • Split the risk: mould at one factory, printed packaging at another supplier, and no release of full source files before contracts are signed.
  • Require destruction or return of surplus branded packaging. Printed cartons are the easiest route for your product to leak into the grey market.

The certification burden shifts to you

Once the product carries your brand, you are the brand owner and the responsible party in the market of sale. Certification belongs to your product; a factory's old report for a similar item does not cover you. Requirements differ by country and change over time, so confirm what is currently in force before every project rather than relying on last year's file.

Test through an independent third-party laboratory and keep the reports issued in your company's name. Then write into the contract that any change of material or sub-supplier requires notification and re-testing.

How do you tell a real OEM factory from an assembler?

Many suppliers call themselves OEM while in fact buying components and assembling them. Ask questions whose answers cannot be faked:

  • Do you have an in-house engineering department? Ask to see a DFM report from a previous project with the client name redacted.
  • Injection machines: how many, and at what clamping tonnage? Is the tool room in-house or a third party?
  • Are printing, assembly and packing done in the building or subcontracted? Who inspects incoming components?
  • Ask for a past OEM project of comparable complexity — not generic production-line photographs.
  • Check the business licence and its registered scope, and confirm the factory's legal name matches the entity that will receive your bank transfer.

Frequently asked questions

What is the short difference between OEM and ODM?

With OEM you own the design and the tooling and the factory executes it. With ODM you buy a design the factory already owns and apply your brand. OEM gives differentiation and stronger protection; ODM gives speed and a much lighter development burden.

Can I move my mould to another factory later?

Yes, if the contract states your full ownership and your right to withdraw the tool. In practice a mould usually needs re-tuning on the new factory's machines, so plan a trial shot before transferring all production.

How many samples should I expect before production?

Typically one or two hand prototypes before tooling, then T1 and T2 shots after the mould is cut, then an approved pre-production sample. Several rounds are a healthy sign that the factory is engineering the product rather than rushing it.

Is the factory's certificate enough to sell my branded toy?

No. A certificate covers one specific product with its materials and design. Your branded item needs testing and a technical file in your own name, and re-testing whenever a material or sub-supplier changes.
